This Privacy Policy explains how Kreator NG, a Nigerian-based digital platform, referred to in this policy as “Kreator”, “we”, “us”, or “our”, collects, uses, discloses, and protects information when you use the website located at kreator.ng, along with any related applications, features, and services, together referred to as the “Platform”.

By creating an account or otherwise using the Platform, you confirm that you have read and understood this Privacy Policy. If you do not agree with this policy, you should not use the Platform.

1. Scope of This Policy

1.1 This policy applies to all visitors, registered users, readers, creators, and any other person who accesses or uses the Platform, referred to collectively in this policy as “users” or “you”.

1.2 This policy applies regardless of the device or method used to access the Platform, including web browsers and any mobile application we may make available.

1.3 This policy does not apply to third-party websites, applications, or services that may be linked from the Platform, and we encourage you to review the privacy practices of any third-party service before providing your information to it.

2. Information We Collect

2.1 Information you provide directly. This includes information you give us when you register for an account, update your profile, publish a story or post, communicate with other users, contact support, or otherwise interact with the Platform. This may include your name or chosen display name, email address, phone number, date of birth where required, profile photograph, biography, and any content you choose to publish or share.

2.2 Payment-related information. When you make or receive a payment on the Platform, including subscribing to a platform tier, subscribing to a creator’s story, tipping a creator, purchasing votes, unlocking a Members-Only article, or receiving a payout, your payment is processed through a third-party payment processor, currently including Paystack, Flutterwave, and Korapay. We do not collect or store your full card number, bank account credentials, or similar sensitive payment credentials on our own servers. We receive limited information from these processors, such as payment confirmations, transaction reference numbers, and the amounts involved, which we use to maintain your wallet balance and transaction history.

2.3 Content and activity information. This includes the stories, episodes, posts, comments, messages, and other content you create or interact with, as well as information about your activity on the Platform, such as reading history, bookmarks, follows, votes cast, and subscription activity.

2.4 Technical and usage information. When you use the Platform, we automatically collect certain technical information, including your internet protocol address, browser type, device type, operating system, referring website, pages viewed, and the dates and times of your visits. This information is generally collected through server logs, cookies, and similar technologies.

2.5 Information from third parties. Where you choose to sign in or interact with the Platform through a third-party service, we may receive limited information from that service, consistent with the permissions you grant.

2.6 Information collected through artificial intelligence features. When you use a feature powered by artificial intelligence, such as story generation or cover image generation, we process the information you submit for that feature, such as your story’s title, synopsis, and genre, in order to generate the requested output.

3. Legal Basis for Processing Your Information

3.1 We process your personal information on one or more of the following legal bases, consistent with the Nigeria Data Protection Act 2023 and applicable regulations issued under it, and, where relevant to a user, other applicable data protection laws.

3.2 Performance of a contract. We process information where it is necessary to provide the Platform to you, including creating and maintaining your account, processing subscriptions and payments, and delivering the features you use.

3.3 Consent. Where required, we rely on your consent, such as for certain marketing communications or optional features, and you may withdraw that consent at any time, in the manner described in this policy.

3.4 Legitimate interests. We process certain information where it serves our legitimate interests, such as maintaining the security of the Platform, preventing fraud and abuse, and improving our services, provided that these interests are not outweighed by your rights and interests.

3.5 Legal obligation. We process certain information where necessary to comply with a legal obligation, including obligations related to financial recordkeeping, taxation, and cooperation with lawful requests from regulators or law enforcement.

4. How We Use Your Information

4.1 We use the information we collect for purposes including the following.

4.1.1 To create, maintain, and secure your account.

4.1.2 To operate the core features of the Platform, including publishing and reading stories and episodes, subscriptions, wallets, tips, votes, story awards, affiliate tracking, messaging, notifications, and any other feature made available to you.

4.1.3 To process payments and payouts, and to maintain accurate records of your wallet balance and transaction history.

4.1.4 To communicate with you, including sending account-related notices, responding to support requests, and, where you have agreed to receive them, marketing or promotional communications.

4.1.5 To personalize your experience, such as recommending stories or creators that may interest you.

4.1.6 To monitor, investigate, and prevent fraud, abuse, and violations of our Terms of Service and our Abuse and Fraud Policy.

4.1.7 To comply with applicable law, respond to lawful requests from public authorities, and enforce our agreements with you.

4.1.8 To analyze usage of the Platform in order to improve its performance, reliability, and features.

5. Cookies and Similar Technologies

5.1 We use cookies and similar technologies to operate the Platform, remember your preferences, keep you signed in, and understand how the Platform is used.

5.2 You may be able to control cookies through your browser settings, including refusing or deleting cookies. If you disable cookies, certain features of the Platform may not function correctly.

6. How We Share Your Information

6.1 We do not sell your personal information to third parties.

6.2 We may share your information in the following circumstances.

6.2.1 With payment processors, currently including Paystack, Flutterwave, and Korapay, solely to the extent necessary to process a payment, subscription, tip, vote purchase, or payout you have initiated.

6.2.2 With service providers who perform functions on our behalf, such as hosting, analytics, customer support tools, and communication services, under obligations of confidentiality consistent with this policy.

6.2.3 With other users, to the extent you choose to make information public, such as your public profile, published stories, comments, and any content you post publicly on the Platform.

6.2.4 With law enforcement, regulators, or other third parties, where we believe in good faith that disclosure is necessary to comply with a legal obligation, protect the rights, property, or safety of Kreator, our users, or the public, or investigate or prevent fraud or abuse.

6.2.5 In connection with a merger, acquisition, restructuring, or sale of assets, your information may be transferred as part of that transaction, subject to appropriate protections.

6.2.6 With your consent, where you direct us to share your information with a specific third party.

7. Anonymous Posting and Your Identity

7.1 The Platform offers a feature that allows an eligible creator to publish a post under an Anonymous identity rather than their real profile.

7.2 When this feature is used, the public-facing byline, avatar, and profile link shown to other users are replaced with a generic Anonymous identity. This does not mean the post is untraceable to us. We retain a record, internally, of the true author of every post published on the Platform, including posts published anonymously, for accountability, moderation, and legal purposes.

7.3 We will not voluntarily reveal the true identity behind an anonymous post to other users. We may disclose this information where required by law, in response to a valid legal process, or where necessary to investigate a violation of our Terms of Service or our Abuse and Fraud Policy.

8. Data Retention

8.1 We retain personal information for as long as your account remains active, and for a reasonable period afterward, as necessary to fulfil the purposes described in this policy, including resolving disputes, enforcing our agreements, and complying with legal, tax, and accounting obligations.

8.2 Transaction records related to payments, subscriptions, and wallet activity are retained for the period required by applicable financial recordkeeping and tax laws, even if you close your account.

8.3 Where information is no longer needed for these purposes, we will take reasonable steps to delete, anonymize, or securely dispose of it.

9. Data Security

9.1 We implement reasonable technical and organizational measures designed to protect your information against unauthorized access, alteration, disclosure, or destruction.

9.2 No method of transmission over the internet, or method of electronic storage, is completely secure. While we work to protect your information, we cannot guarantee its absolute security, and you provide information to us at your own risk.

9.3 You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. Please notify us immediately if you believe your account has been compromised.

10.1 Subject to applicable law, you may have the following rights in relation to your personal information.

10.1.1 The right to request access to the personal information we hold about you.

10.1.2 The right to request correction of inaccurate or incomplete information.

10.1.3 The right to request deletion of your personal information, subject to our legal and legitimate business needs to retain certain information, such as transaction and financial records.

10.1.4 The right to object to, or request that we restrict, certain processing of your information.

10.1.5 The right to withdraw consent, where processing is based on consent, without affecting the lawfulness of processing carried out before withdrawal.

10.1.6 The right to lodge a complaint with the Nigeria Data Protection Commission, or another applicable supervisory authority, if you believe your data protection rights have been violated.

11. Children’s Privacy

11.1 The Platform is not directed to children under the age of 13, and, where a higher minimum age applies under applicable law, that higher age applies instead.
