These Terms of Service, referred to as these “Terms”, form a binding agreement between you and Kreator NG, a Nigerian-based digital platform, referred to as “Kreator”, “we”, “us”, or “our”, governing your access to and use of the website located at kreator.ng, together with any related applications, features, and services, referred to together as the “Platform”.
By creating an account or otherwise accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not access or use the Platform.
1. Definitions
1.1 “Account” means the registered user profile you create to access and use the Platform.
1.2 “Content” means any story, episode, post, comment, image, cover, message, or other material submitted, published, or transmitted through the Platform by you or any other user.
1.3 “Creator” means a user who publishes Content on the Platform, including stories and episodes.
1.4 “Reader” means a user who accesses and engages with Content published by Creators.
1.5 “Story Subscription” means a subscription paid by a Reader to a specific Creator to unlock that Creator’s locked episodes or seasons.
1.6 “Platform Subscription” means a membership plan tied to a user’s Account that determines which platform-level features and privileges that Account has access to.
1.7 “Wallet” means the unified ledger maintained by the Platform reflecting a Creator’s accumulated earnings from all sources available on the Platform.
1.8 “Voting Power” means the mechanism by which Readers cast votes in support of stories entered into Story Awards.
2. Eligibility
2.1 You must be at least 13 years old, or the minimum age required in your jurisdiction to consent to the use of an online service without parental consent, whichever is higher, to create an Account.
2.2 If you are creating an Account on behalf of an organization or business, you represent that you have the authority to bind that organization to these Terms.
2.3 We may refuse to open an Account for any person, or may suspend or terminate an existing Account, at our reasonable discretion, including where we believe a user does not meet these eligibility requirements.
3. Your Account
3.1 You agree to provide accurate, current, and complete information when creating your Account and to keep this information updated.
3.2 You are solely responsible for maintaining the confidentiality of your Account credentials and for all activity that occurs under your Account, whether or not authorized by you.
3.3 You must notify us immediately of any unauthorized access to, or use of, your Account.
3.4 You may not transfer, sell, or share your Account with any other person, and you may not create an Account using a false identity or on behalf of another person without authorization.
4. Description of the Platform
4.1 The Platform is a story publishing and reading service that allows Creators to write, publish, and monetize serialized stories organized into seasons and episodes, and allows Readers to discover, read, follow, support, and interact with Creators and their Content.
4.2 The Platform provides a range of features, which may include, without limitation, Platform Subscriptions, Story Subscriptions, artificial intelligence assisted story and cover generation, a Wallet system for Creator earnings, reader tips, an affiliate program, Story Awards and Voting Power, achievement badges, bookmarks, direct messaging, notifications, text to speech narration, Members Only articles, and account security features such as two factor authentication.
4.3 We may add, modify, suspend, or discontinue any feature of the Platform at any time, with or without notice, and we are not liable to you for any such change.
5. User Generated Content
5.1 You retain ownership of the Content you create and publish on the Platform.
5.2 By submitting Content to the Platform, you grant Kreator a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, distribute, adapt for technical delivery, and otherwise make your Content available through the Platform, for the purpose of operating, promoting, and improving the Platform.
5.3 You represent and warrant that you own or have obtained all necessary rights and permissions to submit the Content you publish and that your Content does not infringe the intellectual property, privacy, or other rights of any third party.
5.4 You are solely responsible for your Content, including its accuracy, legality, and compliance with these Terms.
5.5 We do not endorse any Content published by users, and any views expressed in Content belong solely to the user who published it.
5.6 We reserve the right, but are not obligated, to review, moderate, remove, or restrict access to any Content, at our sole discretion, including where we believe it violates these Terms, our Abuse and Fraud Policy, or applicable law.
6. Artificial Intelligence Features
6.1 The Platform may offer features that use artificial intelligence to assist in generating story episodes, cover images, or other Content, based on information you provide, such as your story’s title, synopsis, and genre.
6.2 You are responsible for reviewing any artificial intelligence-generated draft before publishing it, and for ensuring the final published Content complies with these Terms.
6.3 Artificial intelligence-generated content is provided as a drafting aid and may occasionally be inaccurate, repetitive, or otherwise imperfect. We do not guarantee the quality, originality, or fitness for any particular purpose of artificial intelligence-generated output.
6.4 Access to artificial intelligence features may be limited based on your Platform Subscription tier and may be subject to daily usage limits, which we may adjust at our discretion.
6.5 Once you publish artificial intelligence-assisted Content, you are treated as the author of that Content for all purposes under these Terms, including responsibility for its content and any resulting earnings.
7. Platform Subscriptions
7.1 The Platform may offer multiple Platform Subscription tiers, some of which are offered free of charge and some of which require payment.
7.2 A Platform Subscription determines which platform-level features and privileges an Account has access to, which may include, among other things, the ability to publish Content, monetize Content, use artificial intelligence features, receive a verified badge, publish Content anonymously, and receive Voting Power.
7.3 Paid Platform Subscriptions are billed on a recurring basis, at the price and interval disclosed to you at the time of subscribing, until cancelled.
7.4 You may cancel a paid Platform Subscription at any time. Upon cancellation, you will retain access to the features of your current tier until the end of the then-current billing period, after which your Account will revert to a free tier unless you resubscribe.
7.5 Except as required by applicable law or as otherwise stated at the time of purchase, payments for Platform Subscriptions are non-refundable.
8. Story Subscriptions
8.1 A Creator may choose to lock individual episodes or an entire season of a story, requiring Readers to pay a Story Subscription to that Creator to access the locked Content.
8.2 Story Subscription pricing is set individually by each Creator and may vary between Creators.
8.3 A Reader may hold Story Subscriptions to multiple Creators at the same time, and each Story Subscription is independent of any Platform Subscription the Reader may hold.
8.4 Story Subscription payments are shared between the Creator and Kreator, in accordance with the revenue split in effect at the time of payment, and the Creator’s share is credited to that Creator’s Wallet.
8.5 A Reader may cancel a Story Subscription at any time. Upon cancellation, access to the previously unlocked Content will continue until the end of the then-current billing period, after which it will be locked again unless the Reader resubscribes.
9. Wallet, Earnings, and Payouts
9.1 Amounts earned by a Creator from sources including, without limitation, advertising, affiliate commissions, reader tips, Members Only article unlocks, Story Subscription payments, and Story Award rewards are credited to that Creator’s Wallet.
9.2 A Creator may request a withdrawal of their Wallet balance once it reaches the applicable minimum payout threshold, subject to verification of the Creator’s payout account details.
9.3 We reserve the right to withhold, delay, reverse, or forfeit any amount credited to a Wallet where we reasonably believe that amount resulted from fraud, abuse, a violation of these Terms, or a violation of our Abuse and Fraud Policy, in accordance with that policy.
9.4 You are responsible for any tax obligations arising from amounts earned through the Platform and for providing any tax information reasonably required of you.
10. Reader Tips and Members-Only Articles
10.1 Readers may send a one-time tip to a Creator through that Creator’s public profile. Tips are subject to a service cut retained by Kreator, and the remainder is credited to the Creator’s Wallet.
10.2 A Creator may designate an individual article as Members Only and set a price for it. A Reader who pays that price is granted permanent access to that specific article, subject to a platform cut retained by Kreator, with the remainder credited to the Creator’s Wallet.
10.3 Members Only articles and the monthly limit on free reads for non-subscribed logged-in Readers operate independently of Platform Subscriptions and Story Subscriptions, as further described in our support documentation.
11. Story Awards and Voting Power
11.1 The Platform may run time-bounded Story Award competitions, in which Creators may enter eligible stories, and Readers vote for their favorite entries using Voting Power.
11.2 Certain Platform Subscription tiers include a monthly allotment of free Voting Power. Once a Reader’s free Voting Power for the month has been used, additional votes may require payment, as described in our support documentation.
11.3 Winning entries, and the rewards associated with them, are determined in accordance with the rules published for each Story Award at the time it is run, and such rewards are credited to the winning Creator’s Wallet.
11.4 We reserve the right to disqualify any entry, void any votes, or withhold any reward where we reasonably believe the entry or the votes cast in its favor resulted from fraud, manipulation, or a violation of these Terms or our Abuse and Fraud Policy.
12. Affiliate Program
12.1 Eligible users may participate in our affiliate program, subject to the eligibility requirements in effect at the time, which may include an active Platform Subscription and approved monetization status.
12.2 Affiliate commissions are earned in accordance with the commission model in effect at the time of a qualifying referral and are credited to the referring user’s Wallet upon approval.
12.3 We reserve the right to withhold, reverse, or deny any affiliate commission that we reasonably believe resulted from fraudulent, abusive, or ineligible referral activity, in accordance with our Abuse and Fraud Policy.
13. Anonymous Posting
13.1 Certain eligible Creators may publish Content under an Anonymous identity, in accordance with the terms of that feature described in our support documentation.
13.2 The choice to publish a specific piece of Content anonymously is permanent for that Content and cannot be reversed by the Creator or by us once published.
13.3 Publishing Content anonymously does not relieve you of responsibility for that Content under these Terms and does not prevent us from identifying you internally or disclosing your identity where required by law or necessary to investigate a violation of these Terms.
14. Prohibited Conduct
14.1 You agree that you will not do any of the following while using the Platform.
14.1.1 Publish Content that is unlawful, defamatory, obscene, harassing, threatening, hateful, or that infringes the intellectual property or other rights of any person.
14.1.2 Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
14.1.3 Engage in any form of fraud, including payment fraud, chargeback abuse, affiliate fraud, or manipulation of votes, wallet balances, or any other feature of the Platform.
14.1.4 Create or use multiple Accounts to evade a restriction, limitation, or penalty imposed on you, or to gain an unfair advantage in any feature of the Platform, including Story Awards.
14.1.5 Use any automated means, including bots or scripts, to access the Platform, generate fraudulent activity, or interfere with the normal operation of the Platform.
14.1.6 Attempt to gain unauthorized access to any Account, system, or data that does not belong to you.
14.1.7 Interfere with, disrupt, or place an undue burden on the Platform’s servers or networks.
14.1.8 Reverse engineer, decompile, or otherwise attempt to derive the source code of the Platform, except where such restriction is prohibited by applicable law.
14.2 Additional prohibited conduct related to fraud and abuse is set out in detail in our Abuse and Fraud Policy, which forms part of these Terms.
15. Intellectual Property of the Platform
15.1 The Platform, including its design, software, features, trademarks, and branding, excluding user-submitted Content, is owned by Kreator or its licensors and is protected by applicable intellectual property laws.
15.2 Nothing in these Terms grants you any right to use Kreator’s trademarks, logos, or branding without our prior written consent.
16. Suspension and Termination
16.1 We may suspend or terminate your Account, or restrict your access to any feature of the Platform, at any time, with or without notice, where we reasonably believe you have violated these Terms, our Abuse and Fraud Policy, or applicable law, or where we reasonably believe such action is necessary to protect the Platform, other users, or Kreator.
16.2 You may close your Account at any time by following the process made available in your account settings or by contacting support.
16.3 Upon termination of your Account for a violation of these Terms or our Abuse and Fraud Policy, any Wallet balance associated with fraudulent or abusive activity may be forfeited, in accordance with our Abuse and Fraud Policy.
16.4 Sections of these Terms which by their nature should survive termination, including provisions relating to intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution, will survive termination of your Account.
17. Disclaimers
17.1 The Platform is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose, and non-infringement.
17.2 We do not warrant that the Platform will be uninterrupted, error-free, or secure, or that any defect will be corrected.
17.3 We do not warrant the accuracy, completeness, or reliability of any Content published by users, including artificial intelligence-generated Content, and any reliance on such Content is at your own risk.
18. Limitation of Liability
18.1 To the maximum extent permitted by applicable law, Kreator, its directors, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Platform.
18.2 To the maximum extent permitted by applicable law, our total liability to you for any claim arising out of or relating to these Terms or the Platform will not exceed the greater of the amount you paid to us in the twelve months preceding the claim or an amount reasonably determined under applicable law.
18.3 Nothing in these Terms is intended to exclude or limit any liability that cannot lawfully be excluded or limited under applicable law.
19. Indemnification
19.1 You agree to indemnify and hold harmless Kreator, its directors, officers, employees, and agents from and against any claim, liability, damage, loss, and expense, including reasonable legal fees, arising out of or in any way connected with your Content, your use of the Platform, or your violation of these Terms or our Abuse and Fraud Policy.
20. Governing Law and Dispute Resolution
20.1 These Terms are governed by, and construed in accordance with, the laws of the Federal Republic of Nigeria, without regard to its conflict of law principles.
20.2 Any dispute arising out of or relating to these Terms or the Platform will first be addressed through good-faith negotiation between the parties. If the dispute is not resolved through negotiation within a reasonable period, it will be subject to the exclusive jurisdiction of the courts of Nigeria, unless the parties agree in writing to another form of dispute resolution.
21. Changes to These Terms
21.1 We may update these Terms from time to time to reflect changes in the Platform, our practices, or applicable law.
21.2 Where we make material changes, we will take reasonable steps to notify you before the changes take effect, such as by posting a notice on the Platform.
21.3 Your continued use of the Platform after any changes to these Terms take effect constitutes your acceptance of the revised Terms.
22. General Provisions
22.1 Entire agreement. These Terms, together with our Privacy Policy and our Abuse and Fraud Policy, constitute the entire agreement between you and Kreator regarding your use of the Platform and supersede any prior agreements between you and Kreator on that subject.
22.2 Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
22.3 No waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
22.4 Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
22.5 Notices. We may provide notices to you through the Platform, through the email address associated with your Account, or through any other reasonable means.
